Plain English summary: You pay for a content production service. We produce, quality-check, and publish social media content on your behalf. You retain ownership of all content. We do not guarantee specific business outcomes. You can cancel anytime. If results are not delivered as described, we will make it right or refund you in line with our guarantee policy below.
By accessing or using Forge Content services (the "Service"), creating an account, or making a payment, you ("Client") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all plans including Free, Pro, and Max.
AI can make mistakes. Content is generated by artificial intelligence and may occasionally contain inaccuracies, outdated information or errors. You are responsible for reviewing every post before it is published, including when the optional auto-approve feature is enabled, and FORGE is not liable for content you choose to publish.
FORGE is a content production service that creates, quality-reviews, and publishes social media content on behalf of Clients. The Service includes:

Managed channel add-ons. Some connected-account automation, including managed LinkedIn or multichannel delivery, has an external per-account platform cost and is priced separately from the base Forge plan. Installing the app and using assisted drafting does not start that charge. Before Forge provisions or switches on managed delivery, the portal shows the current monthly add-on price, what it includes, and any per-message credit use; an Owner or Admin must expressly approve it. No managed-channel subscription begins from an app install alone.

The Free plan provides a recurring monthly allowance of 25 credits, which reset each billing month. Credits are spent when content is generated (for example, roughly 3 credits per image post; video posts cost more). Unused Free-plan credits do not roll over; each billing month starts fresh with the standard allowance. No credit card is required to use the Free plan.
Paid plans are billed monthly in advance. Billing begins on the date your paid subscription activates. If you upgrade mid-cycle, you will be charged a prorated amount for the remainder of the billing period.
On paid plans, unused credits roll over to the following month up to a maximum of three times your monthly allowance, and do not expire while your subscription remains active. A new monthly allowance is granted on the first day of each billing cycle. Free-plan credits do not roll over. A daily generation cap also applies to protect service quality. (Purchased top-up packs are separate and expire twelve months after purchase - see 3.4.)
Paid-plan clients may purchase additional credits in top-up packs. Pack credits are added on top of your monthly allowance, are drawn down only after your monthly credits, and remain valid for twelve (12) months from the date of purchase, after which any unused pack credits expire. Credit purchases are non-refundable except where required by law. Pack credits are separate from, and do not increase, your monthly plan allowance or rollover cap.
We may change plan prices, top-up pack prices, and the number of credits that a given feature or action consumes, from time to time. Any such change takes effect from your next billing period. We will give at least 30 days' notice of an increase to your plan price by email or in-app notice. Because credit costs are tied to the cost of our underlying AI and infrastructure providers, the number of credits a specific action consumes may be adjusted for future billing periods to reflect those costs; where a change would materially reduce the value you receive, we will notify you in advance. Continuing to use the Service after a change takes effect constitutes acceptance of the revised pricing.
Connected messaging accounts. Some messaging providers charge FORGE for each account kept connected during a billing period, even when few messages are sent. Managed multichannel delivery is therefore a separate recurring add-on on eligible paid plans, while outbound message actions also use the credits shown in the Service. The current monthly price, included identities and per-message credit use are shown before checkout, and installation or assisted drafting alone never starts the charge. You can cancel the add-on through the Forge billing portal; cancellation takes effect at the end of its current billing period. Disconnecting releases the provider account but does not reverse provider cost already incurred by FORGE for that period.
Credits and plan allowances are provided for genuine, good-faith use of the Service. To protect service quality and keep pricing sustainable, FORGE may apply reasonable rate, volume and daily-generation limits, and may throttle, suspend, or adjust an account that: (a) attempts to circumvent, resell, or automate around credit metering or plan limits; (b) creates multiple or fake accounts to obtain repeated free allowances or referral or badge rewards; (c) generates content or runs outreach at volumes or in patterns that are abusive, automated-at-scale beyond normal use, or that impose disproportionate cost on our AI or data providers; or (d) uses the Service in a way that risks our accounts with, or breaches the terms of, any upstream provider. Free-plan allowances are per organisation and are not intended to be farmed across multiple sign-ups. Where usage is metered by a third-party provider (for example contact enrichment or AI voice), the credit cost reflects that provider's cost plus our margin and may be updated as those costs change (see 3.5).
Clients may request that a post be regenerated (rewritten from scratch using updated AI prompts) within the following limits per post:
A regeneration is triggered by the Client via the Client Portal. Regenerated content replaces the previous draft. Regeneration count resets when a new batch is produced. Regenerations may not be accumulated or transferred between posts.
Clients may submit revision requests for posts that are awaiting approval. A revision is a specific instruction to modify existing content (e.g. change tone, remove a phrase, adjust the hook).
Revision requests must be submitted through the Client Portal. Requests submitted via email or other channels are not covered by the revision SLA.
All paid plan clients (Pro and Max) may enable the auto-approve setting in the Client Portal. When auto-approve is enabled:
Important: By enabling auto-approve, you authorise FORGE to approve and schedule content on your behalf without prior review. FORGE is not liable for the published content of auto-approved posts beyond the quality standards defined in these Terms. You may disable auto-approve at any time via the Client Portal. Disabling auto-approve takes effect from the next batch cycle.
You retain full ownership of all content produced by FORGE for your account. Upon publication or delivery, all intellectual property rights in the content (captions, images produced for your brand, copy) are assigned to you. FORGE retains no rights to reproduce or publish your content beyond the scope of the Service.
You grant FORGE a limited, non-exclusive licence to use your brand assets (logos, fonts, colours, images) solely for the purpose of producing content for your account.
The Community Media Library is an optional feature that lets you share certain media you generated in FORGE so that other FORGE users can reuse it. Sharing is entirely opt-in: nothing is added to the library unless you choose to share it and accept the licence grant below. Eligible media currently includes original text-to-image output generated in FORGE and output from specifically approved open-licence music and video models. User uploads, reference-derived media, synthetic voice or voiceover, media with a logo composited in, and media depicting an identifiable real person are not eligible. FORGE may change the eligible-model list as provider terms or risk requirements change.
When you share media to the Community Media Library, you grant FORGE and every other FORGE user a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, adapt, publish, distribute and display that media within FORGE and on connected social channels, for as long as it remains in the library. You represent and warrant that the shared media was generated by you using FORGE, that you have all rights necessary to grant this licence, and that it contains no third-party trademarks, logos, copyrighted works or identifiable persons. You will indemnify FORGE and other users against any claim arising from a breach of these representations, and this indemnity passes through to any user who reuses the media in good faith. You may remove your media from the library at any time; removal stops future distribution but does not affect copies already reused by other users under the licence granted above. FORGE may remove or take down any shared media at its discretion, including on receipt of a rights complaint.
Ownership of AI-generated content. When you use FORGE to generate images, video, audio, music, or text, you own the resulting output as between you and FORGE, to the extent ownership can be granted. FORGE does not claim ownership of the content you generate. FORGE owns the platform itself, including its software, model integrations, workflows, prompts, and interfaces, and nothing here transfers those to you.
Your responsibility. AI-generated output is not guaranteed to be unique, original, or free of third-party rights, and similar output may be generated for other users. You are responsible for reviewing generated content and ensuring your use of it is lawful and does not infringe any third party. You must not use output to train or build any AI model that competes with FORGE or its underlying providers, and you must meet any AI-disclosure rules that apply to you.
Provider terms. FORGE generates content using third-party AI providers, and some output may be subject to that provider's terms, usage policies, or licences, which may change. Where a provider restricts commercial use, redistribution, or requires attribution, those restrictions apply to your use of that output.
Community sharing. FORGE may let you share generated assets into a shared community library other FORGE customers can view and reuse. Sharing is optional and controlled by you. If you share an asset you confirm you have all rights needed to do so, that it does not infringe any third party, and you grant FORGE and other FORGE customers a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, and incorporate it in their own content. You may only share assets you are permitted to share, and must not share any asset whose provider terms prohibit redistribution. FORGE may remove any shared asset at any time. Reuse of shared assets is at your own risk.
No warranty. Generated content is provided as is. FORGE does not warrant it will be accurate, original, non-infringing, or fit for any purpose.
Ownership of the Forge Materials. The Service and everything comprising it - including all software and source and object code, the platform architecture, databases, data models and schemas, application programming interfaces, the design, layout, structure, organisation, "look and feel", visual identity, and the user interface and user experience, together with all graphics, icons, screens, page designs, feature designs and the selection, sequence and flow of features, the AI agent and automation logic, prompts and prompt-engineering, scoring, ranking and workflow methods, templates, copy, text and documentation, and the Forge Content and AI Job Boost Limited names, logos, get-up and branding (collectively, the "Forge Materials") - are and remain the exclusive property of AI Job Boost Limited trading as Forge Content ("FORGE") and its licensors, and are protected by copyright, database rights, trade mark, trade dress, registered and unregistered design rights, trade secret, confidential information and other intellectual-property laws worldwide. All rights not expressly granted to you are reserved. Your subscription grants only a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own business during your paid term, and transfers no ownership of any Forge Materials to you. This section does not affect your ownership of the content FORGE generates for you under sections 7 and 7.2; it protects the platform that produces it.
Prohibition on copying, imitation and cloning. Except only to the narrow extent a given restriction cannot lawfully be excluded, you, and anyone acting on your behalf or gaining access to the Service through you, must not, in whole or in part and whether directly or indirectly: (a) copy, reproduce, duplicate, scrape, data-mine, harvest, screenshot or record for reuse, download, mirror, republish, distribute, transmit or create derivative works from any of the Forge Materials; (b) imitate, clone, replicate or reproduce the design, layout, structure, "look and feel", user interface, screens, user flows, feature set, wording or visual identity of the Service, or design, build, commission, fund or assist any product, platform, template, "swipe file" or service that is substantially similar to, derived from, or competitive with the Service using any of the Forge Materials or any knowledge, structure or ideas derived from them; (c) reverse engineer, decompile, disassemble or otherwise attempt to discover the source code, prompts, models, data or underlying ideas, structure or algorithms of the Service, except, and only to the minimum degree, that applicable law expressly permits and this prohibition cannot be excluded; (d) remove, obscure, alter or falsify any proprietary, copyright or trade-mark notice; or (e) use the Service, or permit it to be used, to design, develop, train, benchmark, or improve any competing or substantially similar product or service, or to assist any third party to do so. These restrictions survive termination of your account and bind any person who accesses the Service through your credentials or on your instruction.
Remedies and liability for copying. You acknowledge that the Forge Materials are the product of substantial investment, skill, time and expense, that they embody valuable trade secrets and confidential information, and that any breach or threatened breach of this section 7.3 would cause FORGE serious and irreparable harm for which damages alone would not be an adequate remedy. Accordingly, in addition to every other remedy available to it, FORGE is entitled to immediate injunctive and other equitable relief to restrain and prevent any actual or threatened breach, in any jurisdiction, without the need to post any bond or security and without having to prove actual damage, and to recover from the party in breach the fullest relief permitted by law, including all direct, indirect and consequential loss, an account of and the disgorgement of all profits, revenue and savings derived from the breach, statutory and additional damages where available, delivery-up or destruction of infringing materials, and all of FORGE's legal, investigation and enforcement costs on a full-indemnity (solicitor-and-own-client) basis. You will fully indemnify and hold FORGE and its officers, licensors and personnel harmless against all loss, damage, liability, cost and expense arising out of or in connection with any breach of this section. For the avoidance of doubt, none of the limitations, caps or exclusions of liability elsewhere in these Terms apply to, or limit your liability or FORGE's remedies for, a breach of this section 7.3, and FORGE may in addition suspend or terminate your access immediately and pursue every available civil and, where applicable, criminal remedy.
Feedback. If you send FORGE any idea, suggestion, request or feedback about the Service, you grant FORGE a perpetual, irrevocable, worldwide, royalty-free right to use, implement and commercialise it without restriction, attribution or any obligation or payment to you.
Forge includes AI automation features that act on your behalf when you switch them on. These include the Forge Agent (which reviews your account and runs suggested actions), automated cold and follow-up outreach by email and, where you enable it, an AI phone agent, and the AI Reply Assistant, which reads replies from your leads and can draft or automatically send responses from your connected inbox and offer meeting times or your booking link.
These features are off by default and are controlled by you in Setup. You choose the level of automation, for example off, draft for your approval, or full autopilot. Automations that consume credits only run after you switch them on, and the credit cost is shown before you enable them.
You acknowledge that these features are powered by artificial intelligence, that AI can make mistakes, and that content it drafts or sends may occasionally be inaccurate, off-tone or incomplete. When you select an automatic or autopilot setting, messages may be sent from your inbox or calls placed without your prior review. You are responsible for the outreach sent from your account, for reviewing AI output where appropriate, for honouring opt-out and unsubscribe requests, and for ensuring your use complies with applicable laws including anti-spam, telemarketing, consent and data-protection rules (such as the GDPR and the Unsolicited Electronic Messages Act). Forge applies safeguards, including holding replies that appear to be opt-outs or complaints for your review, honouring suppression and consent flags, and per-message limits, but these safeguards are not a substitute for your oversight. Forge is not liable for messages, calls or commitments generated or sent by these features while enabled on your account. You can change the automation level or turn any feature off at any time in Setup.
You are responsible for:
FORGE will not produce content that is defamatory, deceptive, discriminatory, illegal, or that violates the advertising standards of any applicable jurisdiction. FORGE reserves the right to refuse or cancel a content request that violates these standards without refund if the violation was caused by information supplied by the Client.
Clients must not use the Service to produce content for prohibited industries including but not limited to: firearms, adult content, gambling without licencing, multi-level marketing, and cryptocurrency offerings without regulatory approval.
FORGE offers a results guarantee on paid (Pro and Max) plans. If, after 90 days of active use (consistent content delivery and publication), you have not seen measurable improvement in your social media presence, FORGE will either:
To invoke this guarantee, you must contact [email protected] within 7 days of the 90-day period ending. The guarantee does not apply where: the Client has not kept their Brand Profile current, where auto-approve was disabled for more than 50% of the period, where content was approved but not published due to client-controlled platform issues, or where the Client was in arrears.
The results guarantee does not constitute a warranty of specific business outcomes (revenue, leads, sales). It applies to content delivery quality and consistency only.

Business hours are Monday to Friday, 9am to 5pm NZST. SLA clocks start from the time the relevant event is recorded in the FORGE system (not from the time of email or message receipt).
You may cancel your paid subscription at any time via the Client Portal or by emailing [email protected]. Cancellation takes effect at the end of the current billing period. You will not be charged for the following period. No refund is issued for the current billing period except where the results guarantee applies (clause 10) or where FORGE has failed to deliver the minimum post allocation for the period.
Refunds for failure to deliver minimum post allocation are calculated on a pro-rata basis per undelivered post.
In all cases, any refund is limited to, and will never exceed, the total amount actually paid by you to FORGE for the affected billing period. FORGE has no obligation to refund, credit, or compensate you for any amount greater than the fees it has actually received from you, and is not liable for any other loss, cost, or expense.
FORGE operates separate affiliate and strategic partner programs. Each approved participant is assigned to the program shown in their portal. The standard Creator Affiliate program pays a cash commission of 30% of eligible net subscription revenue for the first 12 months. The Strategic Marketing Partner program is not a cash commission: it provides an eligible licence discount of 30% in the first partnership year, 20% in the second, and 10% in the third for new client workspaces that the verified agency owns and brings to Forge. An agency added as an Admin to an existing Forge customer's workspace does not become its owner and does not create or transfer this discount. FORGE may create other programs or agree an individual prospective override; the program, eligibility and rates displayed in the relevant portal govern future eligible transactions after assignment.
Participation is subject to approval and to the following conditions: (a) a referred customer is attributed to the affiliate whose referral link the customer most recently used before subscribing; (b) commissions become payable only after a 30-day holding period from the corresponding customer payment, to allow for refunds, chargebacks and disputes; (c) any commission tied to a payment that is later refunded, reversed, charged back or disputed is cancelled (clawed back); (d) cleared commissions are paid out on the last business day of each month, provided the affiliate's payable balance (commissions that have passed the 30-day holding period) has reached a minimum of USD $50 by that date, using the payout method the affiliate provides; balances below the $50 minimum roll over to the next monthly payout, and affiliates are solely responsible for any taxes on amounts they receive; (e) self-referrals (referring your own account or one you control), incentivised or misleading claims about FORGE, spam, cookie-stuffing, trademark bidding, and any fraudulent or deceptive promotion are prohibited and will result in forfeiture of commissions and removal from the program.
The Affiliate/Influencer Finder available within Boost is a research tool that surfaces publicly available creators and drafts suggested outreach for your review; it does not contact anyone on your behalf, does not guarantee any creator will respond or partner with you, and you are solely responsible for any outreach you choose to send and for complying with applicable marketing, anti-spam and platform rules. Affiliates may securely sign in to review performance and update profile or payout information. FORGE may change, suspend or discontinue an affiliate program or finder tool, reassign an affiliate to another program, or adjust commission rates on a going-forward basis on reasonable notice; accrued commissions are not retroactively reduced.
The Forge App Store lets account holders install, remove and use Forge-built and third-party apps. App permissions are displayed before installation. Installing an app authorises it to access only the listed scopes for the business selected. You may revoke that access by uninstalling the app. Third-party developers, not FORGE, are responsible for their app's functionality, support, claims and compliance unless an app is expressly identified as built by Forge.
Developers must provide accurate manifests, request the minimum permissions needed, use the Forge SDK and documented APIs, keep credentials secret, respect rate limits, prohibit external executable JavaScript where required by review, maintain current customer-support and security contacts, publish a privacy policy, respond to material support requests within two business days, and promptly remediate vulnerabilities. Automated approval is a preliminary technical review, not a warranty or endorsement. FORGE may manually review, reject, suspend or remove any app to protect users, data, platform reliability or legal compliance.
Unless otherwise agreed in writing, developers set a supported positive credit price or monthly subscription price and FORGE retains 20% of the resulting marketplace revenue (the developer keeps 80%). For metered apps, credits are converted to gross settlement revenue at the server-controlled credit settlement value displayed in the developer and admin portals when the usage occurs; that settlement value may differ from a customer's effective plan or top-up price per credit. Any different developer-specific share applies prospectively only and is controlled by FORGE on the server, never by an app manifest. Signed refund, dispute and adjustment entries offset developer revenue, including against future earnings where an earlier event has already settled. Developer net revenue is recorded per app in the developer dashboard. Subject to completed identity, tax and payout verification, cleared balances are settled through the configured payout provider after the hold and minimum shown in the developer portal; FORGE may pause automatic payouts for review. Free Forge-built Core apps remain subject to the plan and credit terms shown in the Service; marketplace availability does not alter existing plan prices.
Public agency listings, secure lead escrow, domain verification, certification, partner communications, removals and agency conduct are also governed by the Agency Marketplace Terms, which form part of these Terms when you use those services.
Developers act as independent controllers for personal data they receive outside Forge's documented processing instructions and must publish appropriate terms and privacy information. Apps may not embed unreviewed executable code, track customers outside disclosed purposes, expand scopes without renewed consent, sell Forge customer data, or bypass Forge billing. Users are responsible for reviewing an app's permissions and suitability. FORGE does not guarantee uninterrupted availability or results from a third-party app and may disable an integration where continued operation creates a security, legal or reliability risk. Uninstalling revokes future access; developers must delete retained customer data on verified request unless law requires retention.
Platform rights. The App Store is operated, curated and evolved at FORGE's discretion. FORGE may at any time: (a) develop, publish, feature and price its own apps and features, including apps or features that are similar to, or compete with, any developer app, and may use aggregated, non-confidential marketplace statistics (such as category demand, installs and ratings) in doing so; (b) determine, change or remove any ranking, placement, featuring, category or discovery mechanic, with no developer having any entitlement to placement or promotion; (c) change store policies, review criteria, technical requirements, SDK versions and revenue shares on thirty (30) days' notice for changes that reduce developer economics, or immediately where required for security or legal reasons; and (d) modify, suspend or permanently discontinue the App Store, or any part of it, in whole or in part. If the App Store is discontinued, FORGE will give developers of then-live paid apps at least sixty (60) days' notice where reasonably practicable, will pay out cleared, verified balances in the ordinary settlement cycle, and has no other liability for lost revenue, lost opportunity or investment made in app development. Nothing in these Terms obliges FORGE to distribute, continue distributing, or approve any app.
App removal. FORGE may remove, suspend, delist or require changes to any app: (a) immediately and without notice where the app presents a security, fraud, malware, data-protection or legal risk, infringes intellectual-property rights, has misrepresented its manifest, scopes or behaviour, or is subject to a court order or credible legal complaint; (b) on notice where the app materially breaches these Terms or store policies, abandons support (including failure to meet the support-response obligation or an unremediated vulnerability), maintains a sustained pattern of verified customer complaints or quality failures, or has become incompatible with a supported SDK or platform change after a reasonable migration window; and (c) otherwise at FORGE's reasonable discretion on thirty (30) days' notice. On removal, new installs stop immediately; existing customer entitlements are wound down or refunded pro rata at FORGE's option, and amounts refunded to customers are deducted from developer balances. Developers may terminate distribution at any time from the developer dashboard, subject to winding down active customer subscriptions.
Developer liability. The limitations of liability in these Terms protect each party's ordinary commercial activity; they do not protect misconduct. A developer's liability is unlimited for, and the developer must indemnify FORGE, AI Job Boost Limited and their officers, employees and contractors in full against, any claim, loss, regulatory penalty or damage arising from the developer's fraud, wilful misconduct, or intentional damage of any kind, including intentionally harmful or deceptive code, unauthorised access to or exfiltration of customer or platform data, deliberate circumvention of review, scopes, rate limits or billing, and deliberate misuse of Forge customer data. FORGE may pursue any such developer for direct, indirect and consequential losses, including the cost of incident response, customer remediation and reputational harm, notwithstanding any liability cap elsewhere in these Terms.
Forge-built apps. Apps identified as built by Forge, including free Core apps, are part of the Service itself and are provided by AI Job Boost Limited under these Terms, not by a separate legal person. They are not third-party apps, and references to "developers" in this section do not apply to them; their availability, pricing and features are governed by the plan and credit terms shown in the Service and may change in accordance with these Terms.
Social Ads Forge connects to supported advertising platforms through Zernio and other disclosed providers. You control campaign objectives, audiences, budgets, creative and launch approval. Your connected advertising platform bills the media budget and its own platform charges directly under your agreement with that platform. FORGE currently charges one Forge credit when a campaign is created or relaunched; a provider launch that fails is automatically refunded. Separate AI creative actions use the credit prices shown before use. Auto-optimisation may pause or scale campaigns only within the limits you select. Performance figures and attribution are estimates and do not guarantee leads, bookings, revenue or return on ad spend.
You confirm that you have the right and lawful basis to upload or sync customer audiences, that your ads, targeting and landing pages comply with each platform's policies and applicable advertising, privacy and anti-discrimination laws, and that you will not target sensitive categories unlawfully. Ad clicks may be connected to Lead Capture, Pipeline and Follow-up features under the data-controller responsibilities in these Terms.
To the maximum extent permitted by applicable law, FORGE's total aggregate liability to you for any and all claims arising from or related to the Service, whether in contract, tort (including negligence), statute, or otherwise, is limited to the total fees actually paid by you to FORGE in the three (3) months immediately preceding the event giving rise to the claim. Where you have paid nothing (for example, on the Free plan), FORGE's total aggregate liability shall not exceed one hundred New Zealand dollars (NZD $100).
In no event shall FORGE be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of business, loss of profits or revenue, loss of goodwill or reputation, loss of data, or business interruption, even if FORGE has been advised of the possibility of such damages.
FORGE is not liable for any act, omission, outage, policy or algorithm change, content rejection, account restriction, suspension, or ban imposed by any third-party platform (including but not limited to Facebook, Instagram, LinkedIn, TikTok, YouTube, and X), nor for the performance, availability, pricing, or discontinuation of any third-party service provider.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law.
Content produced by the Service is generated with the assistance of artificial intelligence and may contain inaccuracies, errors, or omissions. You are solely responsible for reviewing, approving, and verifying all content before it is published, including the accuracy of any claims, offers, prices, testimonials, or statements. FORGE does not warrant that the Service will be uninterrupted, error-free, or secure, or that it will produce any particular result, reach, engagement, or business outcome.
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the New Zealand Consumer Guarantees Act 1993 or other law that cannot lawfully be excluded. Where FORGE is permitted to limit its liability under such law, its liability is limited, at FORGE's option, to re-supplying the Service or paying the cost of having the Service re-supplied.
You agree to indemnify, defend, and hold harmless FORGE, AI Job Boost Limited, and their directors, officers, employees, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) information, brand assets, claims, offers, or materials you supply to FORGE; (b) your use of the Service or content published on your behalf; (c) your breach of these Terms; or (d) your violation of any law or the rights of any third party, including intellectual-property, advertising-standards, consumer-protection, or platform terms.
The Service relies on third-party providers to operate, including without limitation payment processing (Stripe), AI content, image and voice generation (Anthropic, OpenAI and ElevenLabs), social publishing (Zernio and the connected social media platforms), B2B contact discovery and enrichment (Prospeo), email delivery (Resend) and sending from your own connected Google or Microsoft inbox, connected-account messaging (Unipile), WhatsApp Business messaging and telephony (Twilio), optional chat automation (ManyChat), calendar and meeting scheduling (Google, Microsoft and Zoom), and workflow automation (Zapier). Your use of the Service may be subject to those providers' own terms and policies. FORGE is not responsible or liable for the acts, omissions, pricing, availability, security, data handling, or discontinuation of any third-party provider, and no such event entitles you to any refund or compensation beyond fees actually paid for Service not delivered.
FORGE is not liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labour disputes, internet or telecommunications failures, power outages, cyber-attacks, or the failure, outage, or policy change of any third-party platform or service provider.
FORGE reserves the right to suspend or terminate your account immediately and without refund if you: breach these Terms, provide false or misleading information, fail to pay fees when due, or use the Service for prohibited purposes. FORGE will provide written notice of termination where possible.
FORGE may update these Terms from time to time. Material changes will be notified by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you may cancel your subscription before the effective date.
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and FORGE regarding the Service and supersede any prior agreements or representations. FORGE's failure to enforce any right or provision is not a waiver of that right or provision.
These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.

Plain English summary: We collect your business information and brand data to produce content and run your funnel for you. We do not sell your data and we do not use it for advertising. We use trusted third-party providers (listed in a table below) who are bound by their own data-processing agreements. This Privacy Policy describes how we collect, use, share, and protect personal information when you use our Service. It is written to meet our obligations under the EU and UK General Data Protection Regulation (GDPR), the UK Privacy and Electronic Communications Regulations (PECR), and applicable data-protection law.
For the purposes of GDPR, AI Job Boost Limited is the data controller for the personal data of our account holders. For the personal data of your own customers, leads, and contacts that you process through the Service, you are the controller and we are your processor (see clause 12).

When you create an account we collect: your name, email address, business name, hashed access code or password, plan and billing information (billing is processed securely through Stripe). We do not store full credit card numbers. We use this to create and operate your account and to provide the Service you have requested.
To produce content we ask you to provide: your brand voice, target audience profile, content pillars, business story, offers, and examples of content you like. This information is stored in our system and used to generate content for your account.
Our Brand Profile includes fields for describing your audience's psychology including their desires, beliefs, fears, and goals. This information relates to your customers, not to you personally. It is used solely to improve the quality of content we produce for your brand.
Media you upload (images, video, audio, logos and brand assets) is stored and processed so we can produce and publish content for you. AI image and video models may process these files to generate derivative content at your request.
We collect standard usage logs including: login timestamps, page views within the Client Portal, post approval actions, and regeneration requests. On our public website, with your consent, we collect aggregate, anonymous analytics (see clause 9). This data is used to operate, secure, and improve the Service and is never sold.
To act on your behalf, we store access tokens or opaque linked-account identifiers for the accounts you choose to connect: social media platforms (to publish content), Google and Microsoft (to send email from your inbox and to read availability and create calendar events), Zoom (to create meetings), Stripe (to take payments through your account), Unipile (to operate the messaging accounts you connect), Twilio (for telephony and optional WhatsApp Business messaging), and ManyChat (for optional WhatsApp or chat automation). Platform credentials are encrypted at rest; managed Unipile connections store only the opaque account identifier in Forge. Connections are used only for features you enable and can be revoked from the Connections screen or the provider.
When you use the funnel features, we store the leads and contacts you capture through your forms, landing pages and imports (such as name, email, phone and message), and a record of the outbound communications sent to them. You are the controller of this data and we process it on your behalf to operate your pipeline and follow-up (see clause 12).
Outbound emails you send to your leads through Forge include a small tracking image (a 1x1 pixel) and, where links are used, redirect tracking. When the recipient's email client loads that image or the recipient clicks a tracked link, we record that the message was opened or clicked, the time, and a count, on that lead's record in your pipeline. This is how your open and click statistics are produced. Tracking is not applied to a lead who has opted out. Recipients can prevent open tracking by disabling remote images in their email client, and every message carries an opt-out link.
Where you have switched on automated follow-up and enabled the relevant trigger, an email open or a form submission can cause the platform to place an automated AI phone call to that lead a short time later (by default about two minutes after an open), because they are engaged at that moment. This is a real processing purpose and we describe it plainly here. It is gated: the call is only placed if the lead gave contact consent through your form or landing page, has not opted out, has a phone number, came from an opt-in source rather than cold prospecting, and only within their own local calling hours. Cold and hand-added contacts are never auto-dialled by this trigger. You control the trigger and its delay in your automation settings, and you can switch it off.
Automated AI phone calls are handled by our voice provider (ElevenLabs) over telephony (Twilio). After a call, a summary of the conversation, the outcome, the needs the person described and a lead score are written to that person's contact card in your pipeline and are visible to you and your team. The call itself is processed by the voice provider under its own terms. The AI agent discloses on the call that it is an automated, AI-driven assistant.

We do not use your brand data or content for any purpose other than delivering the Service to you, and we improve our AI quality only using anonymised, aggregated data.
We share personal data only as needed to provide the Service. The providers below act as our processors or sub-processors under their own data-processing agreements (DPAs) and may only use the data to perform their function. We do not sell your data and we do not share it with any third party for advertising or marketing purposes.

Each provider only receives the data needed to perform its function. Their own privacy policies and terms apply to their handling of that data.
Some of our providers are located outside the European Economic Area (EEA) and the United Kingdom, including in the United States. Where personal data is transferred outside the EEA or UK, we rely on the safeguards offered by those providers, which typically include the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum), and, where applicable, the provider's certification under the EU-US Data Privacy Framework. We take reasonable steps to ensure your data continues to be protected to the standard required by applicable law.
We retain your account data for as long as your account is active and for a period of 12 months after you cancel or delete your account, after which it is deleted or anonymised, except where we are required to keep certain records longer (for example, billing and tax records). Published post content and brand profile data are retained for up to 24 months to allow for audit and dispute resolution. Leads and contacts you import are retained while your account is active and deleted or returned on termination in line with clause 12.
Leads, prospects and call summaries. Our published default retention periods for the contact data held in your pipeline are: cold prospects that were never engaged, 180 days from discovery; leads with no activity of any kind, 730 days; leads closed Lost, 365 days; AI call summaries and transcript text on a contact card, 365 days. Contacts marked Won are retained while your account is active because they represent a customer relationship. These periods are configurable per account, and your administrator can review exactly what a given policy would affect before anything is applied. We do not currently run an automatic purge against these periods: they are applied on request and on account closure. If that changes we will notify you in advance under clause 15. Regardless of these periods, an opt-out or erasure request is honoured as described below and in clause 8.
Opt-out and erasure of a contact. When one of your leads or prospects unsubscribes, asks to be removed, or tells our AI caller they are not interested, we mark them opted out immediately and permanently delete their contact details within 24 hours. So that the deletion cannot accidentally undo the opt-out, we keep a one-way cryptographic hash of their email address, phone number and website domain on a suppression list. That hash cannot be reversed into a person's details and is never used to contact anyone. It exists solely so that our prospecting tools recognise and skip that person if they are ever discovered again.
You can delete your account at any time from the in-app "Delete account" option, or by emailing [email protected]. On a full account erasure we remove your account record, your posts, your leads and contacts, your forms and landing pages, your feedback and alert records, your connected-platform records, and your stored files (media library, email campaigns and reward records). Your connected-account access tokens are held encrypted on your account record and are removed with it; you can also revoke them at any time from the provider. Two things are not removed by that operation and we say so plainly: billing and payment records held by Stripe, which we are required to retain for tax and accounting purposes, and any copies already held by the sub-processors listed in clause 5, which must be requested from those providers directly. You may also request deletion of specific data under clause 8.

When you first visit our public site you are shown a cookie banner. Analytics cookies are not set until you click Accept. If you click Decline, Google Analytics is never initialised. Your choice is remembered in your browser. You can change your choice at any time by clearing the "forge_cookie_consent" value in your browser storage, or by using the "Cookie settings" link in our footer where available, which re-shows the banner. You can also opt out using Google's browser opt-out add-on or your browser's cookie controls.
AI can make mistakes. Content, images, video, voice, on-page chat replies and phone calls produced through the Service may be generated by artificial intelligence and can contain inaccuracies, outdated information, or errors. You are responsible for reviewing every post, message, and call script before it is published or sent, and for the accuracy of any claims, offers, prices, or statements. AI output carries no guarantee of accuracy, non-infringement, or fitness for a particular purpose, and human review is advised.
AI transparency to the people you reach. Where the Service interacts with your customers and leads on your behalf, it identifies itself as AI: the on-page AI chat assistant and the automated AI phone agent disclose that the person is interacting with an automated, AI-driven system. This is intended to support transparency obligations such as those under the EU AI Act. You remain responsible for how you deploy these features and for any additional disclosures your own use case or jurisdiction requires.
Which AI providers process which data. The AI providers we use, and the data they receive, are listed in the sub-processor table in clause 5 (Anthropic, OpenAI, Google, FAL and ElevenLabs). We send these providers only the prompts, brand inputs, reference media, and call or message content needed to perform the requested generation.
Training. To the best of our knowledge, content sent to Anthropic, OpenAI and Google through their paid API tiers is not used by default to train their general models. Other AI providers are used under their standard API terms. We do not control these providers' practices, which may change, and we encourage you not to submit sensitive personal data into content prompts.
We implement reasonable, industry-standard security measures including: encryption in transit (TLS), encryption at rest for sensitive secrets and connected-account tokens, signed session credentials, access controls that limit staff access to client data on a need-to-know basis, bot and abuse protection at signup, and periodic security reviews. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
For the personal data of your own customers, leads, and contacts that you collect, import, or generate through the Service, you are the data controller and Forge acts as your processor, processing that data on your documented instructions to provide the funnel, pipeline, and outbound features you enable. In that capacity we commit to:

The Prospecting and Boost features help you discover businesses that may be a fit for your services, find the verified business email or LinkedIn profile of a decision-maker at a company you target, and reach out by email, LinkedIn, or AI-assisted phone call. Because you decide who to contact, you are the sender and the data controller for this outreach, and you are responsible for using it lawfully. By enabling Prospecting you confirm and agree that:
If we become aware of a personal data breach that is likely to result in a risk to the rights and freedoms of affected individuals, we will notify the relevant supervisory authority without undue delay and, where required, within 72 hours of becoming aware of it. Where the breach is likely to result in a high risk to you or to data subjects, we will also notify the affected individuals without undue delay. Where we act as your processor (clause 12), we will notify you without undue delay after becoming aware of a breach affecting your data so that you can meet your own notification obligations.
The Service is intended for businesses and is not directed at children. It is not for use by anyone under 18 years of age, and we do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us and we will delete it.
